Article25

Ifacitizen,alegalpersonoranyotherorganization,bringsasuit

directlybeforeapeople''''scourt,theadministrativeorganthatundertook

thespecificadministrativeactshallbethedefendant.

Forareconsideredcase,iftheorganthatconductedthereconsideration

sustainstheoriginalspecificadministrativeact,theadministrative

organthatinitiallyundertooktheactshallbethedefendant;ifthe

organthatconductedthereconsiderationhasamendedtheoriginalspecific

administrativeact,theadministrativeorganwhichconductedthe

reconsiderationshallbethedefendant.

Iftwoormoreadministrativeorganshaveundertakenthesamespecific

administrativeact,theadministrativeorgansthathavejointlyundertaken

theactshallbethejointdefendants.

Ifaspecificadministrativeacthasbeenundertakenbyanorganization

authorizedtoundertaketheactbythelaworregulations,the

organizationshallbethedefendant.Ifaspecificadministrativeacthas

beenundertakenbyanorganizationasentrustedbyanadministrative

organ,theentrustingorganshallbethedefendant.

Ifanadministrativeorganhasbeenabolished,theadministrativeorgan

thatcarriesontheexerciseoffunctionsandpowersoftheabolished

organshallbethedefendant.

Article26

Ajointsuitshallbeconstitutedwhenonepartyorbothpartiesconsist

oftwoormorepersonsandtheadministrativecasesareagainstthesame

specificadministrativeactoragainstthespecificadministrativeactsof

thesamenatureandthepeople''''scourtconsidersthatthecasescanbe

handledtogether.

Article27

Ifanyothercitizen,legalpersonoranyotherorganizationhasinterests

inaspecificadministrativeactunderlitigation,heoritmay,asa

thirdparty,filearequesttoparticipateintheproceedingsormay

participateinthemwhensonotifiedbythepeople''''scourt.

Article28

Anycitizenwithnocapacitytotakepartinlitigationshallhaveoneor

morelegalrepresentativeswhowillactonhisbehalfinasuit.Ifthe

legalrepresentativestrytoshifttheirresponsibilitiesontoeachother,

thepeople''''scourtmayappointoneofthemastherepresentativeofthe

principalinlitigation.

Article29

Eachpartyorlegalrepresentativemayentrustoneortwopersonsto

representhiminlitigation.

Alawyer,apublicorganization,anearrelativeofthecitizenbringing

thesuit,orapersonrecommendedbytheunittowhichthecitizen

bringingthesuitbelongsoranyothercitizenapprovedbythepeople''''s

courtmaybeentrustedasanagentadlitem.

Article30

Alawyerwhoservesasanagentadlitemmayconsultmaterialspertaining

tothecaseinaccordancewithrelevantprovisions,andmayalso

investigateamongandcollectevidencefromtheorganizationsandcitizens

concerned.Iftheinformationinvolvesstatesecretsortheprivate

affairsofindividuals,heshallkeepitconfidentialinaccordancewith

relevantprovisionsofthelaw.

Withtheapprovalofthepeople''''scourt,partiesandotheragentsadlitem

mayconsultthematerialsrelatingtothecourtproceedingsofthecase,

exceptthosethatinvolvestatesecretsortheprivateaffairsof

individuals.

ChapterVEvidence

Article31

Evidenceshallbeclassifiedasfollows:

(1)documentaryevidence;

(2)materialevidence;

(3)audio-visualmaterial;

(4)testimonyofwitnesses;

(5)statementsoftheparties;

(6)expertconclusions;and

(7)recordsofinquestsandrecordsmadeonthescene.

Anyoftheabove-mentionedevidencemustbeverifiedbythecourtbefore

itcanbetakenasabasisforascertainingafact.

Article32

Thedefendantshallhavetheburdenofproofforthespecific

administrativeacthehasundertakenandshallprovidetheevidenceand

regulatorydocumentsinaccordancewithwhichtheacthasbeenundertaken.

Article33

Inthecourseoflegalproceedings,thedefendantshallnotbyhimself

collectevidencefromtheplaintiffandwitnesses.

Article34

Apeople''''scourtshallhavetheauthoritytorequestthepartiesto

provideorsupplementevidence.

Apeople''''scourtshallhavetheauthoritytoobtainevidencefromthe

relevantadministrativeorgans,otherorganizationsorcitizens.

Article35

Inthecourseoflegalproceedings,whenapeople''''scourtconsidersthat

anexpertevaluationforaspecializedproblemisnecessary,theexpert

evaluationshallbemadebyanexpertevaluationdepartmentasspecified

bylaw.Intheabsenceofsuchadepartment,thepeople''''scourtshall

designateonetoconducttheexpertevaluation.

Undercircumstanceswherethereisalikelihoodthatevidencemaybe

destroyedorlostordifficulttoobtainlateron,theparticipantsin

preserved.Thepeople''''scourtmayalsoonitsowninitiativetakemeasures

topreservesuchevidence.

ChapterVIBringingaSuitandAcceptingaCase

Acitizen,alegalpersonoranyotherorganizationmay,withinthescope

ofcasesacceptabletothepeople''''scourts,applytoanadministrative

organatthenexthigherlevelortoanadministrativeorganasprescribed

bythelaworregulationsforreconsideration,anyonewhorefusesto

acceptthereconsiderationdecisionmaybringasuitbeforeapeople''''s

court;acitizen,alegalpersonoranyotherorganizationmayalsobring

asuitdirectlybeforeapeople''''scourt.

Incircumstanceswhere,inaccordancewithrelevantprovisionsoflawsor

regulations,acitizen,alegalpersonoranyotherorganizationshall

firstapplytoanadministrativeorganforreconsiderationandthenbring

asuitbeforeapeople''''scourt,ifheoritrefusestoacceptthe

reconsiderationdecision,theprovisionsofthelawsorregulationsshall

apply.

Article38

Ifacitizen,alegalpersonoranyotherorganizationappliestoan

administrativeorganforreconsideration,theorganshallmakeadecision

withintwomonthsfromthedayofthereceiptoftheapplication,except

asotherwiseprovidedforbylaworregulations.Anyonewhorefusesto

acceptthereconsiderationdecisionmaybringasuitbeforeapeople''''s

courtwithin15daysfromthedayofthereceiptofthereconsideration

decision.Iftheadministrativeorganconductingthereconsiderationfails

tomakeadecisionontheexpirationofthetimelimit,theapplicantmay

bringasuitbeforeapeople''''scourtwithin15daysafterthetimelimit

forreconsiderationexpires,exceptasotherwiseprovidedforbylaw.

Article39

Ifacitizen,alegalpersonoranyotherorganizationbringsasuit

directlybeforeapeople''''scourt,heoritshalldosowithinthreemonths

fromthedaywhenheoritknowsthataspecificadministrativeacthas

beenundertaken,exceptasotherwiseprovidedforbylaw.

Article40

Ifacitizen,alegalpersonoranyotherorganizationfailstoobserve

thetimelimitprescribedbylawduetoforcemajeureorotherspecial

reasons,heoritmayapplyforanextentofthetimelimitwithinten

daysaftertheobstacleisremoved;therequestedextentshallbedecided

byapeople''''scourt.

Article41

Thefollowingrequirementsshallbemetwhenasuitisbrought:

(1)theplaintiffmustbeacitizen,alegalpersonoranyother

organizationthatconsidersaspecificadministrativeacttohave

infringeduponhisoritslawfulrightsandinterests;

(2)theremustbeaspecificdefendantordefendants;

(3)theremustbeaspecificclaimandacorrespondingfactualbasisfor

thesuit;and(4)thesuitmustfallwithinthescopeofcasesacceptable

tothepeople''''scourtsandthespecificjurisdictionofthepeople''''scourt

whereitisfiled.

Article42

Whenapeople''''scourtreceivesabillofcomplaint,itshall,upon

examination,fileacasewithinsevendaysordecidetorejectthe

complaint.Iftheplaintiffrefusestoacceptthedecision,hemayappeal

toapeople''''scourt.

ChapterVIITrialandJudgment

Article43

Apeople''''scourtshallsendacopyofthebillofcomplainttothe

defendantwithinfivedaysoffilingthecase.Thedefendantshallprovide

thepeople''''scourtwiththedocumentsonthebasisofwhichaspecific

administrativeacthasbeenundertakenandfileabillofdefencewithin

tendaysofreceivingthecopyofthebillofcomplaint.Thepeople''''s

courtshallsendacopyofthebillofdefencetotheplaintiffwithin

fivedaysofreceivingit.Failurebythedefendanttofileabillof

defenceshallnotpreventthecasefrombeingtriedbythepeople''''scourt.

Article44

Duringthetimeoflegalproceedings,executionofthespecific

administrativeactshallnotbesuspended.Executionofthespecific

administrativeactshallbesuspendedunderoneofthefollowing

circumstances:

(1)wheresuspensionisdeemednecessarybythedefendant;

(2)wheresuspensionofexecutionisorderedbythepeople''''scourtatthe

requestoftheplaintiffbecause,intheviewofthepeople''''scourt,

executionofthespecificadministrativeactwillcauseirremediable

lossesandsuspensionoftheexecutionwillnotharmpublicinterests;or

(3)wheresuspensionofexecutionisrequiredbytheprovisionsoflawsor

regulations.

Article45

Administrativecasesinthepeople''''scourtsshallbetriedinpublic,

exceptforthosethatinvolvestatesecretsortheprivateaffairsof

individualsorareotherwiseprovidedforbylaw.

Article46

Administrativecasesinthepeople''''scourtsshallbetriedbyacollegial

panelofjudgesorofjudgesandassessors.Thenumberofmembersofa

collegialpanelshallbeanoddnumberofthreeormore.

Article47

Ifapartyconsidersamemberofthejudicialpersonneltohavean

interestinthecaseortobeotherwiserelatedtoit,whichmayaffect

theimpartialhandlingofthecase,thepartyshallhavetherightto

demandhiswithdrawal.

Ifamemberofthejudicialpersonnelconsidershimselftohavean

interestinthecaseortobeotherwiserelatedtoit,heshallapplyfor

withdrawal.

Theprovisionsofthetwoprecedingparagraphsshallapplytocourt

clerks,interpreters,expertwitnessesandpersonswhoconductinquests.

Thewithdrawalofthepresidentofthecourtasthechiefjudgeshallbe

decidedbythecourt''''sadjudicationcommittee;thewithdrawalofamember

ofthejudicialpersonnelshallbedecidedbythepresidentofthecourt;

thewithdrawalofotherpersonnelshallbedecidedbythechiefjudge.

Partieswhorefusetoacceptthedecisionmayapplyforreconsideration.

Article48

Iftheplaintiffrefusestoappearincourtwithoutjustifiedreasons

afterbeingtwicelegallysummonedbythepeople''''scourt,thecourtshall

considerthisanapplicationforthewithdrawalofthesuit;ifthe

defendantrefusestoappearincourtwithoutjustifiedreasons,thecourt

maymakeajudgmentbydefault.

Article49

Ifaparticipantintheproceedingsoranyotherpersoncommitsanyofthe

followingacts,thepeople''''scourtmay,accordingtotheseriousnessof

hisoffence,reprimandhim,orderhimtosignastatementofrepentanceor

imposeuponhimafineofnotmorethan1,000yuanordetainhimfornot

longerthan15days;ifacrimeisconstituted,hiscriminal

responsibilityshallbeinvestigated:

(1)evadingwithoutreason,refusingtoassistinorobstructingthe

executionofthenoticeofapeople''''scourtforassistanceinits

executionbyapersonwhohasthedutytorenderassistance;

(2)forging,concealingordestroyingevidence;

(3)instigating,suborningorthreateningotherstocommitperjuryor

hinderingwitnessesfromgivingtestimony;

(4)concealing,transferring,sellingordestroyingthepropertythathas

beensealedup,seizedorfrozen;

(5)usingviolence,threatsorothermeanstohinderthepersonnelofa

people''''scourtfromperformingtheirdutiesordisturbingtheorderofthe

workofapeople''''scourt;or(6)insulting,slandering,framing,beating

orretaliatingagainstthepersonnelofapeople''''scourt,participantsin

proceedingsorpersonnelwhoassistintheexecutionofduties;Afineor

detentionmustbeapprovedbythepresidentofapeople''''scourt.Parties

whorefusetoacceptthepunishmentdecisionmayapplyfor

reconsideration.

Apeople''''scourtshallnotapplyconciliationinhandlingan

administrativecase.

Article51

Beforeapeople''''scourtannouncesitsjudgmentororderonan

administrativecase,iftheplaintiffappliesforthewithdrawalofthe

suit,orifthedefendantamendsitsspecificadministrativeactand,asa

result,theplaintiffagreesandappliesforthewithdrawalofthesuit,

thepeople''''scourtshalldecidewhetherornottogranttheapproval.

Article52

Inhandlingadministrativecases,thepeople''''scourtsshalltakethelaw,

administrativerulesandregulationsandlocalregulationsasthe

criteria.Localregulationsshallbeapplicabletoadministrativecases

withinthecorrespondingadministrativeareas.Inhandlingadministrative

casesofanationalautonomousarea,thepeople''''scourtsshallalsotake

theregulationsonautonomyandseparateregulationsofthenational

autonomousareaasthecriteria.

Inhandlingadministrativecases,thepeople''''scourtsshalltake,as

references,regulationsformulatedandannouncedbyministriesor

commissionsundertheStateCouncilinaccordancewiththelawand

administrativerulesandregulations,decisionsorordersoftheState

Councilandregulationsformulatedandannounced,inaccordancewiththe

lawandadministrativerulesandregulationsoftheStateCouncil,bythe

people''''sgovernmentsofprovinces,autonomousregionsandmunicipalities

directlyundertheCentralGovernment,ofthecitieswherethepeople''''s

governmentsofprovincesandautonomousregionsarelocated,andofthe

largercitiesapprovedassuchbytheStateCouncil.

Ifapeople''''scourtconsidersregulationsformulatedandannouncedbya

localpeople''''sgovernmenttobeinconsistentwithregulationsformulated

andannouncedbyaministryorcommissionundertheStateCouncil,orif

itconsidersregulationsformulatedandannouncedbyministriesor

commissionsundertheStateCounciltobeinconsistentwitheachother,

theSupremePeople''''sCourtshallreferthemattertotheStateCouncilfor

interpretationorruling.

Article54

Afterhearingacase,apeople''''scourtshallmakethefollowingjudgments

accordingtothevaryingconditions:

(1)Iftheevidenceforundertakingaspecificadministrativeactis

conclusive,theapplicationofthelawandregulationstotheactis

correct,andthelegalprocedureiscompliedwith,thespecific

administrativeactshallbesustainedbyjudgment.

(2)Ifaspecificadministrativeacthasbeenundertakeninoneofthe

followingcircumstances,theactshallbeannulledorpartiallyannulled

byjudgment,orthedefendantmayberequiredbyjudgmenttoundertakea

specificadministrativeactanew:

a.inadequacyofessentialevidence;

b.erroneousapplicationofthelaworregulations;

c.violationoflegalprocedure;

d.exceedingauthority;or

e.abuseofpowers.

(3)Ifadefendantfailstoperformordelaystheperformanceofhis

statutoryduty,afixedtimeshallbesetbyjudgmentforhisperformance

oftheduty.

(4)Ifanadministrativesanctionisobviouslyunfair,itmaybeamended

byjudgment.

Article55

Adefendantwhohasbeenjudgedbyapeople''''scourttoundertakea

specificadministrativeactanewmustnot,basedonthesamefactand

reason,undertakeaspecificadministrativeactessentiallyidenticalwith

theoriginalact.

Article56

Inhandlingadministrativecases,ifapeople''''scourtconsidersthehead

ofanadministrativeorganorthepersondirectlyinchargetohave

violatedadministrativediscipline,itshalltransfertherelevant

materialstotheadministrativeorganortheadministrativeorganatthe

nexthigherlevelortoasupervisoryorpersonneldepartment;ifa

people''''scourtconsidersthepersontohavecommittedacrime,itshall

transfertherelevantmaterialstothepublicsecurityandprocuratorial

organs.

Article57

Apeople''''scourtshallpassajudgmentoffirstinstancewithinthree

monthsfromthedayoffilingthecase.Extentofthetimelimit

necessitatedbyspecialcircumstancesshallbeapprovedbyahigher

people''''scourt,extentofthetimelimitforhandlingacaseoffirst

instancebyahigherpeople''''scourt,extentofthetimelimitforhandling

acaseoffirstinstancebyahigherpeople''''scourtshallbeapprovedby

theSupremePeople''''sCourt.

Article58

Ifapartyrefusestoacceptajudgmentoffirstinstancebyapeople''''s

court,heshallhavetherighttofileanappealwiththepeople''''scourt

atthenexthigherlevelwithin15daysoftheservingofthewritten

judgment.Ifapartyrefusestoacceptanorderoffirstinstancebya

people''''scourt,heshallhavetherighttofileanappealwiththe

people''''scourtatthenexthigherlevelwithin10daysoftheservingof

thewrittenorder.Alljudgmentsandordersoffirstinstancebya

limitnecessitatedbyspecialcircumstancesshallbeapprovedbyahigher

people''''scourt,extentofthetimelimitforhandlinganappealedcaseby

ahigherpeople''''scourtshallbeapprovedbytheSupremePeople''''sCourt.

Article61

Apeople''''scourtshallhandleanappealedcaserespectivelyaccordingto

theconditionssetforthbelow:

(1)ifthefactsareclearlyascertainedandthelawandregulationsare

correctlyappliedintheoriginaljudgment,theappealshallberejected

andtheoriginaljudgmentsustained;

(2)ifthefactsareclearlyascertainedbutthelawandregulationsare

incorrectlyappliedintheoriginaljudgment,thejudgmentshallbe

amendedaccordingtothelawandregulations;or

(3)ifthefactsarenotclearlyascertainedintheoriginaljudgmentor

theevidenceisinsufficient,oraviolationoftheprescribedprocedure

mayhaveaffectedthecorrectnessoftheoriginaljudgment,theoriginal

judgmentshallberescindedandthecaseremandedtotheoriginalpeople''''s

courtforretrial,orthepeople''''scourtofthesecondinstancemayamend

thejudgmentafterinvestigatingandclarifyingthefacts.Thepartiesmay

Ifthepresidentofapeople''''scourtfindsaviolationofprovisionsof

thelaworregulationsinalegallyeffectivejudgmentororderofhis

courtanddeemsitnecessarytohavethecaseretried,heshallreferthe

mattertotheadjudicationcommittee,whichshalldecidewhetheraretrial

isnecessary.

Ifapeople''''scourtatahigherlevelfindsaviolationofprovisionsof

thelaworregulationsinalegallyeffectivejudgmentororderofa

people''''scourtatalowerlevel,itshallhavethepowertobringthecase

upfortrialitselfordirectthepeople''''scourtatthelowerlevelto

conductaretrial.

Ifthepeople''''sprocuratoratefindsaviolationofprovisionsofthelaw

orregulationsinalegallyeffectivejudgementororderofapeople''''s

court,itshallhavetherighttolodgeaprotestinaccordancewith

proceduresofjudicialsupervision.

ChapterVIIExecution

Article65

Thepartiesmustperformthelegallyeffectivejudgmentororderofthe

people''''scourt.Ifacitizen,alegalpersonoranyotherorganization

refusestoperformthejudgmentororder,theadministrativeorganmay

applytoapeople''''scourtoffirstinstanceforcompulsoryexecutionor

proceedwithcompulsoryexecutionaccordingtolaw.Ifanadministrative

organrefusestoperformthejudgmentororder,thepeople''''scourtof

firstinstancemayadoptthefollowingmeasures:

(1)informingthebanktotransferfromtheadministrativeorgan''''saccount

theamountofthefinethatshouldbereturnedorthedamagesthatshould

bepaid;

(2)imposingafineof50to100yuanperdayonanadministrativeorgan

thatfailstoperformthejudgmentororderwithintheprescribedtime

limit,countingfromthedaywhenthetimelimitexpires;

(3)puttingforwardajudicialproposaltotheadministrativeorgan

superiortotheadministrativeorganinquestionortoasupervisoryor

prescribedbylaw,neitherbringsasuitnorcarriesoutthespecific

administrativeact,theadministrativeorganmayapplytoapeople''''scourt

forcompulsoryexecution,orproceedwithcompulsoryexecutionaccording

tolaw.

ChapterIXLiabilityforCompensationforInfringementofRights

Article67

Acitizen,alegalpersonoranyotherorganizationwhosuffersdamage

becauseoftheinfringementuponhisoritslawfulrightsandinterestsby

aspecificadministrativeactofanadministrativeorganorthepersonnel

ofanadministrativeorgan,shallhavetherighttoclaimcompensation.

Ifacitizen,alegalpersonoranyotherorganizationmakesan

independentclaimfordamages,thecaseshallfirstbedealtwithbyan

administrativeorgan.Anyonewhorefusestoacceptthedispositionbythe

administrativeorganmayfileasuitinapeople''''scourt.Conciliationmay

beappliedinhandlingasuitfordamages.

Article68

Ifaspecificadministrativeactundertakenbyanadministrativeorganor

thepersonnelofanadministrativeorganinfringesuponthelawfulrights

andinterestsofacitizen,alegalpersonoranyotherorganizationand

causesdamage,theadministrativeorganortheadministrativeorganto

whichtheabove-mentionedpersonnelbelongsshallbeliablefor

compensation.

Afterpayingthecompensation,theadministrativeorganshallinstruct

thosemembersofitspersonnelwhohavecommittedintentionalorgross

mistakesinthecasetobearpartorallofthedamages.

Article69

Thecostofcompensationshallbeincludedasanexpenditureinthe

governmentbudgetatvariouslevels.Thepeople''''sgovernmentsatvarious

levelsmayordertheadministrativeorgansresponsibleforcausingthe

compensationtobearpartorallofthedamages.Thespecificmeasures

thereofshallbeformulatedbytheStateCouncil.

ChapterXAdministrativeProcedureInvolvingForeignInterests

Article70

ThisLawshallbeapplicabletoforeignnationals,statelesspersonsand

foreignorganizationsthatareengagedinadministrativesuitsinthe

People''''sRepublicofChina,exceptasotherwiseprovidedforbylaw.

Article71

Foreignnationals,statelesspersonsandforeignorganizationsthatare

engagedinadministrativesuitsinthePeople''''sRepublicofChinashall

havethesamelitigationrightsandobligationsascitizensand

organizationsofthePeople''''sRepublicofChina.Shouldthecourtsofa

foreigncountryimposerestrictionsontheadministrativelitigation

rightsofthecitizensandorganizationsofthePeople''''sRepublicof

China,theChinesepeople''''scourtsshallfollowtheprincipleof

reciprocityregardingtheadministrativelitigationrightsofthecitizens

andorganizationsofthatforeigncountry.

Article72

IfaninternationaltreatyconcludedoraccededtobythePeople''''s

RepublicofChinacontainsprovisionsdifferentfromthosefoundinthis

Law,theprovisionsoftheinternationaltreatyshallapply,unlessthe

provisionsareonesonwhichthePeople''''sRepublicofChinahasannounced

reservations.

Article73

Whenforeignnationals,statelesspersonsandforeignorganizations
